Terms of Use of the Application
These Terms of Use (hereinafter referred to as the "Terms") govern the use of the Emigrator mobile and/or web application (hereinafter referred to as the "Application"), intended to provide informational and reference content for migrants in the Republic of Poland. By using the Application, the user confirms that they have read these Terms and fully accept them.
1. General provisions
These Terms of Use govern the use of the Emigrator Application. The Application is intended to provide informational and reference content for migrants in the Republic of Poland.
2. Legal basis
The Application operates in accordance with the laws of the Republic of Poland and Regulation (EU) 2016/679 of the European Parliament and of the Council (RODO/GDPR).
3. Purpose and features of the Application
The Application offers: informational articles and support materials; checklists with the ability to mark, edit and personalise them; an AI assistant operating automatically; a catalogue and map of third-party services; advertising and informational materials of service providers; a provider dashboard for adding and managing services; plans for service visibility and promotion; document scanning using the camera (optional); sorting/displaying services by geolocation (optional).
All information is for informational purposes only and does not constitute legal, migration, financial or other professional advice.
4. Use without registration and authorisation
The user may use the Application without registration or authorise via Google or Facebook. In case of authorisation, the user's data (including selected checklists and settings) may be synchronised between different devices.
5. Device permissions (camera and geolocation)
For some features, the Application may request device permissions: camera — for document scanning; geolocation — for sorting/displaying nearby services. Permissions are optional. The user may refuse permissions or revoke them in the device settings — in such case, some features may be unavailable.
6. User responsibility
The user is responsible for the accuracy of data provided during authorisation and for maintaining access to their account. The Application Administration is not responsible for unauthorised access to the account caused by the user's fault.
7. AI assistant
The AI assistant operates automatically, uses predefined scenarios and algorithms, and may contain inaccuracies or outdated information. AI assistant responses do not replace consultations with authorities or specialists.
8. Service providers and advertisements
The Application may contain offers and advertisements from third parties. The Application Administration is not a contractual party between the user and the service provider and is not responsible for the quality, timing or result of third-party services.
8.1 Service provider account
A service provider may create an account or log in to the provider dashboard to add and manage their services in the Application.
The service provider agrees to provide true, current and complete information. The service provider is fully responsible for the content, contact details, descriptions, photos, logos, prices, scope of services and other materials added by them to the Application.
The Administrator may refuse to publish, hide, edit or remove a service if it contains false, misleading or unlawful information, infringes third-party rights, violates good standards or is inconsistent with the nature of the Application.
Publishing a service in the Application does not constitute a recommendation, certification or quality guarantee by the Administrator.
8.2 Relationship between the user and the service provider
The Application Administrator is not a party to any agreement concluded between the user and the service provider.
All arrangements regarding price, timing, scope, quality, performance of the service, complaints or refunds are made directly between the user and the service provider, unless expressly stated otherwise.
The Administrator is not responsible for the actions, omissions, quality of services, prices, availability, timing or results of services provided by third parties.
8.3 Visibility and promotion of services
The Application may offer different levels of service visibility, including standard display, highlighting, positioning, presence in selected categories, display on the map, a "verified" badge or other promotional features.
The availability of particular features may depend on the selected plan, Application settings, moderation and the Administrator's decision.
The "verified" badge may mean that the Administrator has performed a basic verification of the provider or service data, but it does not guarantee the quality, effectiveness or legality of all actions of the service provider.
9. Monetisation, plans and subscriptions
At the time of publication, selected features may be available free of charge as part of a testing period. The Administrator may in the future activate paid plans, subscriptions or other paid features for service providers.
Plans may differ in the scope of features, service visibility, access to statistics, service highlighting, publication in selected categories or other features described in the Application.
Prices, billing period, feature scope and cancellation rules will be visible before purchase or activation of a paid feature.
If payment is processed through an app store or an external payment provider, the payment, renewal and cancellation of the subscription may be subject to the rules of that provider or store.
The Administrator may change the scope of plans, prices or availability of features by informing users of significant changes in the Application or in another appropriate way.
9.1 Testing period
During the testing period, selected features may be provided free of charge regardless of the selected plan. This means that prices and plan limitations may not yet be active.
The Administrator may end the testing period, activate plan limitations or introduce payments by informing users or service providers in the Application.
10. Intellectual property
All materials in the Application are subject to intellectual property rights and are protected by law. Copying, distributing or using materials without the consent of the rights holder is prohibited.
11. Changes to the Terms
The Administrator may make changes to the Terms. The current version is always available in the Application.
